TERMS AND CONDITIONS

Wendy's Craft Mall is a web service created and owned by Wendy Legeret, P.O. Box 241, Iron Mountain, Michigan, 49801. Wendy's Craft Mall, http://www.wendyscraftmall.com, is maintained by Wendy Legeret.

DISCLAIMER

The information contained within Wendy's Craft Mall is the ownership of Wendy Legeret. In the event that these terms and conditions have changed, vendors must abide by new terms and conditions regardless of any past terms and conditions. Furthermore, all new terms and conditions will be sent to each vendor at Wendy's Craft Mall. If you do not abide by these terms and conditions, your account can be suspended or permanently terminated.

RENEWALS

You will be notified by the method you chose in your registration. Renewals must be received within 24 hours of original registration date. If your renewal is past the 24 hours, and you wish to remain at Wendy’s Craft Mall, you must renew within the next 24 hours in order to be charged the current fee. Once the 48 hours are up, and you wish to remain at Wendy’s Craft Mall, and wish to keep the setup fee waived (if it applies), you must renew within 60 days. However, if you are more than 60 days past the original renewal date, and wish to renew your listing, you will be charged the current listing rate and a new setup fee (if it applies).

PAYMENTS

All payments to Wendy's Craft Mall by way of check, cashier’s check, and money orders are to be made payable to Wendy Legeret – NO EXCEPTIONS. Personal and business checks are accepted. Certain information must be present, including full name or name of company – full address (P.O. boxes are not acceptable) – and phone number. Temporary checks are not accepted. Check numbers must be present and printed. Hand written check numbers are unacceptable and checks will be returned to sender. Payments by check need ten business days to clear our financial institution. If your check is denied by our financial institution, you will be charged $35. This will cover the charges our financial institution charged to us. Orders sent using PayPal is sent to the e-mail address: register@wendyscraftmall.com. Visa, MasterCard, Discover, and American Express are accepted through PayPal. Other forms of payment through PayPal is the amount in your account to cover the cost of the payment, PayPal credit, debit cards, online checking, or cash via Money Pak. Cash is also accepted. For security reasons, when sent by mail, all checks, money orders, cashier’s checks, and cash, must be placed between the registration for security purposes. If you are making a payment via Western Union, you must notify us 24 hours in advance so we can make arrangements to be available to receive payment. Payment must be made payable to Wendy Legeret, the city is Iron Mountain, the state is Michigan, the phone number if needed is (906) 239-0489, the address if needed is P.O. Box 241, and the zip code is 49801.

SELLING CRAFTS

It is free to list craft items for sale. This includes crafts and craft supplies. There is no set time period for listing your items or for selling them. All craft sales are made through Wendy's Craft Mall. Once a sale has been made, a 7% commission is immediately taken out. The remaining sale will be sent directly to the seller’s PayPal account. Crafter’s who do not have a PayPal account will be sent their total sales on the fifteenth of the month along with a sales receipt.

Crafters who wish to rent a booth or list their website will pay a fee. Please read below for the information on booths and website links.

CRAFT BOOTHS

Craft booth renters will pay an initial setup fee of $30 plus the first month’s rent. In order to remain in the mall, the crafter must renew their booth. Yearly craft booth renters will pay $75 per year. No setup fee will be charged. Crafters can list their crafts in an unlimited number of stores. Their booth’s name can be listed in an unlimited number of categories. There are no charges for changes or updates to the booth or listings.

WEBSITE LINKS

Crafters who wish to list their website have the option of purchasing a yearly link or a permanent link. The yearly link is $10 per year and the permanent link is $15. In order to remain in the mall, the link must be renewed every year. Permanent links are not renewable as they are permanently listed in the mall.

GIFT CERTIFICATES

You do not have to be a member of Wendy’s Craft Mall to order gift certificates for your business. All gift certificates are printed on high quality colored card stock to match the holiday, occasion, or business. When mailed, it is sent with a matching envelope, and a contact card (gives information on how to find you). Gift certificates are $2.50 each. This pays for the materials used to make them.

Crafters who rent craft booths or are selling crafts can sell gift certificate through Wendy’s Craft Mall. Gift certificates can be in any amount you wish or you can let your customer decide. Crafters can only sell gift certificates through PayPal and the certificates will be used towards the customer’s purchase.

COUPONS

You do not have to be a member of Wendy’s Craft Mall to order coupons for your business. All coupons are printed eight per sheet on special paper and are numbered. Each sheet is $2.00.

Crafters who rent craft booths or sell their crafts can offer coupons to customers. Crafter’s who are renting a booth can use them for online purchases or print them out to use during their craft shows. If you are selling crafts, the coupon will automatically be given as an option so visitors can choose how they wish to purchase your craft.

UPDATES

All changes are updated within 24 hours in the order it was received.

FEES FOR MALL SPACE

Crafters who have purchased a place in our mall will be charged the following:

Craft Booths

per month - $10 plus $30 for one time setup fee

per year - $75 - no setup fee

Selling Crafts

Listings are free

7% commission per sale

Crafter Website Links

per year - $10

permanent listing - $15

RENEWALS

Because rental booths and yearly crafter website link accounts are not under contract, they do not have to be renewed. However, if you wish to remain at Wendy's Craft Mall, you must renew your registration.

Notifications

If your renewal is past the 24 hours, and you wish to remain at Wendy’s Craft Mall, you must renew within the next 24 hours in order to be charged the current fee. However, if you are more than 60 days past the original renewal date, and wish to renew your listing, you will be charged the current listing rate and a new setup fee (yearly craft booth renters do not have a setup fee).

AFFILIATE PROGRAM

As an affiliate, you will be promoting Wendy's Craft Mall, while at the same time, earning commissions on all crafter’s who pay for their registration. The Wendy's Craft Mall Affiliate Program is free and is available to anyone who is a legal resident of the United States, and is at least 18 years old. When you sign-up, you will be sent a free information packet which will give you tips and materials to get you started. Commissions are paid on the first of every month and must reach a minimum of $25 before being paid out. If the minimum of $25 is not met, your commissions will not be lost but will be carried over to the following month(s) until the minimum is met. Commissions can be earned on all packages. Extra commissions can be earned by the number of paying crafters who have been referred by you, the affiliate.

REGULATIONS TO SELL A CRAFT THROUGH A BOOTH OR THE MALL

All crafter’s and / or businesses who have a rented booth or selling crafts, must abide by the following terms and conditions. If under any circumstances these terms are not met, your booth or crafts listed for sale can be temporarily removed from Wendy's Craft Mall. At that time, you will have 24 hours to fix the problem areas. If the areas have not been fixed, your booth or crafts listed for sale will be permanently removed and all funds paid to Wendy Legeret will not be refunded.

o offensive,

o promotes racism, terrorism, hatred or physical harm of any kind against any group or individual

o or links to web sites that promote the same,

o harasses or advocates harassment of another person,

o exploits people in a sexual or violent manner,

o contains pornography, violence, or offensive subject matter or contains a link to an adult web

o site,

o promotes information that you know or have reason to believe is false or misleading or

o promotes illegal activities or conduct that is objectionable, abusive, threatening, obscene,

o defamatory or libelous,

o promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated music or links to pirated music files or file sharing, or

o criminal activity or any tortuous act or civil wrong, pornography, incitement to racial hatred, incitement to terrorism, fraud, posting obscene material, drug dealing, harassment, stalking, spamming, sending of viruses or other harmful files, copyright infringement, trade mark infringement, breach of confidence or theft of trade secrets.

REGULATION TO LIST A WEBSITE

All crafter’s and / or businesses who have listed their website link as a yearly link or as a permanent link must abide by the following terms and conditions. ACCOUNT CLOSURE

In the event you wish to close your account with Wendy's Craft Mall and you have a balance on your account, you must inform Wendy Legeret within five business days of your next billing date and pay your bill in full. Your billing date is the date that you registered with Wendy's Craft Mall. If the invoice has not been paid, you will receive a late payment charge of $5.00. The late charge will continue every month until the balance is paid in full.

TERMINATION OF ACCOUNT

Violation of these terms and conditions can result in temporary or even permanent termination from Wendy's Craft Mall. All payments and funds paid to Wendy Legeret will not be refunded to crafters and / or businesses. Wendy Legeret, in our sole discretion, has the right to suspend or terminate your account and refuse any and all current and future use of this service, for any reason at any time due to the violation of these terms and conditions. Such termination of this service can result in the deactivation or deletion of your account or your access to your account, and the forfeiture and relinquishment of all content in your account. Wendy Legeret reserves the right to refuse to anyone for any reason at any time if we feel the registrant will be in violation of these terms and conditions.
